Indonesia  implements new annual reporting rule for all patent holders

Following an amendment to its Patent Law on October 28, 2024, Indonesia now requires all holders of active patents to submit an annual statement detailing how their patents are being implemented in the country. 

To facilitate this new obligation while a formal implementation of the regulation is still pending, the Directorate General of Intellectual Property (DGIP) has introduced a temporary feature in its online filing system. This requirement applies to all active patents, regardless of their grant date.

According to the DGIP, the annual working statement must be submitted via its online system by December 31 each year, using the official template provided. Patentees must declare the status of their patent’s implementation – such as manufacturing, importation or licensing – or simply state if it has not yet been worked in Indonesia. Currently, no official fee or supporting documentation is required beyond a scanned copy of the signed form, and the DGIP is provisionally accepting overdue statements until the final regulation is enacted.

The DGIP said that failure to comply with this annual requirement poses significant legal risks, including the potential for compulsory licensing or the partial or complete invalidation of the patent. To mitigate these risks, patent holders should promptly review their Indonesian patent portfolios to assess the working status of each invention and ensure the timely submission of their annual statements.
